These terms and policies explain the basis on which HostingServicesWA provides web hosting, email hosting, domain name and related services. We have tried to keep them straightforward and in plain English. By ordering, renewing or continuing to use a HostingServicesWA service, you agree to the terms that apply to that service.
Nothing in these terms is intended to exclude, restrict or modify any right or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable Australian law.
1. Our services
HostingServicesWA provides web hosting, email hosting, domain name registration and management, and related services. The features, storage and pricing that apply to your service are those described in your quotation, invoice, welcome information or the relevant plan on our website.
We may use third-party suppliers, registrars, data centres, networks and software platforms to provide parts of these services. While HostingServicesWA remains your point of contact, some matters may depend on the systems, rules or availability of those providers.
2. Accounts, contact details and security
You are responsible for providing accurate and current contact information and for keeping account, email, cPanel and other passwords secure. Please tell us promptly if your contact details change or if you believe an account has been compromised.
You are also responsible for activity carried out using your account or credentials unless the activity results from something for which HostingServicesWA is legally responsible.
3. Fees, invoices and renewals
Hosting and related recurring services are invoiced in advance. We normally send a renewal invoice around 30 days before the service is due. The invoice may be paid at any time from issue up to the due date shown on the invoice.
If you no longer require a service, please contact us before its renewal date. Services that remain unpaid after their due date may be suspended or, after a reasonable period and appropriate notice where practicable, cancelled. Restoration after cancellation may not always be possible.
Hosting plans can be upgraded or downgraded as your needs change. Please contact HostingServicesWA and we can discuss the most suitable option.
4. Service availability and uptime
HostingServicesWA aims to provide reliable services and targets approximately 99% uptime for hosting services. This is a service objective rather than a guarantee that every service will be available without interruption at all times.
From time to time a service may be affected by planned or emergency maintenance, hardware or software faults, network or upstream-provider issues, domain or DNS problems, security incidents, internet-wide events, power or data-centre issues, or other circumstances outside our reasonable control.
Where a service issue occurs, we will make reasonable efforts to investigate it and restore affected services as soon as reasonably practicable.
5. Backups and customer data
We take reasonable care in operating our hosting services, but customers should always keep their own current backup of important website files, databases, email and other data. A hosting account should not be treated as the only copy of important information.
Where backup facilities are provided, they are an additional safeguard and should not replace your own independent backup. We cannot guarantee that a particular backup will always be available, complete or suitable for every recovery situation.
6. Acceptable use
HostingServicesWA services must not be used for unlawful activity, spam or unsolicited bulk email, phishing, malware, deliberate attacks, unauthorised access, copyright infringement, or other activity that may harm our systems, our suppliers, other customers or internet users.
Services must also be used reasonably within the resources of the hosting plan. If an account causes serious security, stability or resource problems, we may need to restrict or suspend the affected service while the issue is investigated. Where practical, we will contact you and work with you to resolve the problem.
7. Domain names
Domain name registrations are subject to the rules and policies of the relevant registry, registrar and governing body. For Australian .au domain names, this includes the rules administered by .au Domain Administration (auDA). Eligibility requirements can apply to names such as .com.au, .net.au, .org.au, .id.au and .au.
You are responsible for ensuring that information supplied for a domain registration is accurate and that you are eligible to hold the domain name. Registration is not guaranteed until it has been successfully processed by the relevant registry or registrar.
We can assist with registrations, renewals, transfers and domain management, but registry or registrar rules may sometimes limit what can be changed, recovered or renewed.
8. Support and customer service
Setup and Migration
Free setup and migration is provided for straightforward hosting transfers requiring up to 30 minutes of setup or migration assistance. This generally includes standard website and email setup, or transfers where an existing hosting provider provides suitable backup or migration facilities.
More complex migrations may require additional work and may incur a setup or migration fee. This can include large websites or email accounts, numerous mailboxes, limited available storage, unavailable or incomplete backups, incompatible hosting platforms, manual data transfers, or situations where automated cPanel-to-cPanel migration is not available.
Where additional charges are likely to apply, HostingServicesWA will discuss this with you before undertaking the additional work.
We aim to provide friendly, practical support and to reply to emails within 24 hours, usually much sooner. Some technical issues may require investigation by an upstream provider or other third party and can therefore take longer to resolve.
If something goes wrong, please contact us. We will do our best to investigate the issue, explain what has happened where we can, and work with you towards a fair and amicable resolution.
9. Limitation of liability
HostingServicesWA takes reasonable care in providing its services. However, internet-based services can occasionally be interrupted or affected by circumstances outside our reasonable control, and we cannot promise uninterrupted or error-free operation at all times.
To the extent permitted by law, HostingServicesWA is not liable for indirect, incidental or consequential loss arising from an interruption, loss of data, third-party service failure, or circumstances outside our reasonable control. Where liability cannot legally be excluded, any rights and remedies available under applicable law continue to apply.
Nothing in this section excludes, restricts or modifies consumer guarantees or other rights that cannot lawfully be excluded, restricted or modified.
10. Privacy Policy
HostingServicesWA respects your privacy. We collect personal information that is reasonably necessary to provide and manage services, communicate with you, issue invoices and renewal notices, provide support, and meet domain-name registration or legal requirements.
Information we may collect
This can include your name, business name, postal address, phone number, email address, ABN and information relevant to the services you ask us to provide. Domain registrations may require additional registrant information under the rules of ICANN, auDA, registries or registrars.
How we use and disclose information
We use your information to provide, administer and support your services. Where necessary, information may be supplied to service providers such as hosting infrastructure providers, domain registrars or registries so they can perform services on our behalf or meet applicable domain-name requirements.
We do not sell your personal information. We may also disclose information where required or authorised by law.
Security and retention
We use reasonable administrative and technical measures to help protect personal information from unauthorised access, alteration, loss or misuse. No method of storage or transmission is completely risk-free. We retain information for as long as reasonably necessary to provide services, respond to enquiries and meet legal, accounting and taxation obligations.
Access and correction
You may contact us to ask what personal information we hold about you, or to request that inaccurate information be corrected, subject to applicable legal requirements.
Cookies
Our website may make limited use of cookies or similar browser storage for normal website functionality. Browser settings can generally be used to control cookies.
Data breaches
If an eligible data breach occurs, we will assess and respond to it in accordance with applicable Australian privacy requirements, including notification obligations where they apply.
11. Changes to these terms and policies
We may update these terms and policies from time to time to reflect changes to our services, suppliers, technology, law or industry requirements. The current version will be published on this website with its last-updated date. We will not use a change to remove rights that cannot lawfully be excluded.
